Acceptance of these Terms

XLibertia is a private adult social platform where members can meet open-minded adults, share content and interact with the community.

By creating an account, accessing or using XLibertia, you agree to these Terms of Use and to the other policies made available on the platform.

If you do not agree to these Terms, you must not create an account or use XLibertia.

Your account

You must provide accurate and current information when creating and maintaining your account.

You are responsible for:

• protecting your password and login details;
• all activity carried out through your account;
• keeping your email address and profile information up to date; and
• notifying XLibertia if you believe your account has been accessed without permission.

You must not sell, transfer, share or lend your account to another person.

You must not impersonate another person, create a misleading identity or use an account to deceive, threaten or harm other members.

XLibertia may refuse or restrict usernames, profiles or accounts that are misleading, abusive, fraudulent or likely to create a safety risk.

Your responsibilities

You must use XLibertia lawfully, respectfully and in accordance with these Terms and our other policies.

You must respect the choices, privacy, boundaries and consent of other members.

You must not use XLibertia to publish, request, promote or distribute:

• content involving or appearing to involve a minor;
• intimate content shared without the free and informed consent of every person shown;
• secretly recorded, stolen or unlawfully obtained content;
• sexual exploitation, trafficking, coercion or abuse;
• credible threats, harassment, blackmail or intimidation;
• deceptive impersonations or manipulated intimate content published without consent;
• private personal information published without permission;
• fraudulent offers, scams, spam, malware or harmful links; or
• any content or activity that violates applicable law.

This list is not exhaustive. Additional behavioural and content rules may be described in policies published on XLibertia.

Ownership of your content

You retain ownership of the content you upload.

By uploading content, you grant XLibertia a non-exclusive, worldwide and royalty-free licence to:

• host, store and back up the content;
• display it according to the visibility settings you select;
• resize, transcode or otherwise technically process it;
• scan and review it for security, legal compliance and moderation;
• make it available through the normal operation of the platform; and
• preserve it where reasonably necessary for backups, investigations, disputes or legal obligations.

This licence is limited to operating, protecting, moderating and improving XLibertia. It does not transfer ownership of your content to XLibertia.

The licence ends when the content is permanently deleted, except where temporary backup copies or legally required records must be retained.

Visibility and content protection

XLibertia may provide different visibility levels, including public, private and restricted albums.

You are responsible for selecting the appropriate visibility for your content and for understanding who may be able to view it.

Members must not:

• copy or redistribute another member’s content without permission;
• bypass privacy or visibility controls;
• share access to restricted content with unauthorised persons; or
• use another member’s content outside XLibertia without permission.

XLibertia may use technical measures intended to discourage unauthorised downloading or redistribution. However, no technical system can guarantee that content viewed by another person will never be captured, copied or reproduced.

You should only upload content that you are comfortable sharing with the audience selected.

Moderation and enforcement

XLibertia may use automated systems and human review to detect, examine and moderate accounts, profiles, messages, text, images and videos.

Depending on the circumstances, XLibertia may:

• limit the visibility of content;
• place content into review or quarantine;
• request additional information;
• remove or disable content;
• restrict access to features;
• issue a warning;
• temporarily suspend an account;
• permanently terminate an account; or
• preserve or disclose information where required by law.

Moderation systems may not detect every violation, and the absence of immediate action does not mean that content has been approved.

Reports and removal requests

Members may report content, profiles, messages or behaviour that may violate these Terms or another XLibertia policy.

Reports must be made honestly and must contain sufficient information for the issue to be reviewed.

Misusing the reporting system to harass another member, submit knowingly false claims or interfere with legitimate content may result in account restrictions.

Requests concerning non-consensual intimate content, impersonation, minors or immediate safety risks may receive priority treatment.

Private beta and Founding Member status

XLibertia may operate as a private beta while the platform is being tested and improved.

During the beta period:

• features may be added, modified, interrupted or removed;
• access may be limited;
• accounts and content may receive additional review;
• performance or availability may vary; and
• member feedback may be used to improve the platform.

Founding Member status and related benefits are not automatic.

XLibertia may grant, modify or withdraw Founding Member status based on activity, authenticity, behaviour, compliance with platform rules and other reasonable criteria.

Beta access or Founding Member benefits do not create a permanent entitlement to any particular feature, price or level of service.

Member interactions and meetings

XLibertia provides tools for members to communicate and connect, but it is not a party to relationships, meetings or arrangements between members.

XLibertia does not guarantee:

• that a member’s identity or profile information is accurate;
• that another member will behave safely or lawfully;
• compatibility between members; or
• the outcome of any online or in-person interaction.

You are responsible for your own decisions and safety.

When meeting another member, take reasonable precautions, protect your personal information, communicate your boundaries and stop any interaction that does not feel safe or consensual.

Suspension and termination

You may stop using XLibertia at any time and may request deletion of your account through the available account controls or contact process.

XLibertia may restrict, suspend or terminate an account where reasonably necessary to:

• enforce these Terms or another platform policy;
• protect members or the platform;
• investigate suspected fraud, abuse or illegal activity;
• respond to a security risk;
• comply with a legal obligation; or
• address prolonged inactivity where permitted by the applicable policy.

Serious violations may result in immediate termination without prior warning.

Termination does not prevent XLibertia from retaining information where reasonably necessary for legal compliance, fraud prevention, safety investigations, dispute resolution or enforcement.

Service availability and responsibility

XLibertia is provided on an “as available” basis.

We aim to provide a reliable and secure service, but we do not guarantee that the platform will always be available, uninterrupted, error-free or compatible with every device.

Maintenance, security incidents, technical failures, third-party services, legal requirements or beta development may affect availability.

To the maximum extent permitted by law, XLibertia is not responsible for:

• content published by members;
• conduct or decisions of other members;
• losses resulting from off-platform interactions;
• unauthorised copying performed by another person; or
• indirect or unforeseeable losses arising from use of the platform.

Nothing in these Terms excludes or limits rights or liabilities that cannot legally be excluded.

Changes to these Terms and additional policies

XLibertia may update the platform and these Terms as the service, applicable laws or safety requirements evolve.

The effective date and version will be updated when these Terms change.

Where a change is material, XLibertia may provide reasonable notice through the platform, by email or by another appropriate method.

Your continued use of XLibertia after updated Terms take effect constitutes acceptance where permitted by law.

If you do not agree to an update, you must stop using the service and may request deletion of your account.

These Terms should be read together with the policies made available on XLibertia, including the Privacy Policy, Community Charter, Consent & Safety Policy, Moderation Policy and Reporting & Appeals Policy.
